Contradict Between Morality and Benefit and Basic Principles of Civil Law
Abstract: In the basic principles of Civil law there is contradict between protection of private benefits and that of social and governmental benefits. The contradiction is the result of the dispute between morality and benefit in the history of legal thoughts in China and foreign countries. The relationship between morality and benefit changes from conflict with each other to harmony, which reflects the historical process that civil legal regulation came into being and become modernized. The result of harmony is the correct judgement on morality. The basic principles of civil law are just the modern quintessence of harmony.
