摘 要：《日本国宪法》确立了彻底的和平原则，但是在实施过程中，其和平原则通过盟军最高司令官的命令、宪法解释、宪法判例、条约、法律五种方式被篡改、架空从而消失。这一蜕变是四个方面的因素共同作用的结果：美国为了自身利益，篡改宪法；宪法规范抽象概括，为篡改宪法提供了可乘之机；违宪审查制形同虚设，失去了护卫宪法的最后防线；日本社会宪政意识薄弱、缺乏对宪法权威的信仰是宪法被篡改的思想根源。《日本国宪法》和平性的消失损害了宪法权威，破坏了法制的统一；对日本经济的发展造成一定的不良影响；为世界和平带来了新的隐患。

The Disappearance of The Principle of Peace of The Constitution of Japan

Abstract： The Constitution of Japan established the peace principle, but when apply the Constitution, the peace principle withered away through the order of SCAP, the interpretation of constitution, constitutional cases, statutes and treaties. There are four factors for the change: the United States altered the Constitution for its benefit; the Constitution prescription is abstract; the system of constitutional safeguard didn’t play the role; the Japanese community doesn’t have the constitutional sense and Constitutional spirit .The principle of peace of the Constitution of Japan withered away have an bad impact on the development of Japanese economy, destroyed the authority of Constitution and the unification of legal institution, bring new hidden trouble to the world.
